May I Purchase Adult Recreational Cannabis At Mercy Wellness?

Yes! As of January 1,  2018 Mercy Wellness was Licensed by the City of Cotati and the State of California to sell recreational cannabis.

What are the new limits to edible potency and other cannabis concentrates?
Yes. For adult-use sales, no single edible package can contain more than 100mg of THC. Edible products must also contain no more than 10mg of THC per serving.

Adult use cannabis concentrates can contain no more than a 1,000 milligrams.

Medical patients can, for a short period purchase higher dose edibles that were in Mercy’s dispensary inventory before 2018. After that inventory is sold, all edible products for the adult or medical use will be no more than 100mg of THC per package and 10mg THC per serving.

Where will I be able to publicly use cannabis?

Most public spaces prohibit smoking or vaping cannabis products just like tobacco. Please be respectful of these prohibitions. Mercy and the City of Cotati prohibits smoking cannabis in Mercy’s parking lot.

 It is still illegal in 2020 to smoke cannabis and drive.

Is there a daily limit that I can purchase?

Yes. There are new daily limits for Medical and Adult-Use. Mercy Wellness abides by these rules.

Will all products and flower need to be in child resistant packaging?

Anything you purchase from Mercy Wellness is required to leave Mercy in a certified child resistant packaging in an opaque exit bag. Remember to keep your cannabis away from children and pets at home!

Will I be able to purchase recreational cannabis anonymously?

State law will requires recreational cannabis purchasers a set daily limit on the quantity of cannabis a person can buy. Mercy is required to scan your ID card. Mercy takes your privacy very seriously and unless you have signed up for Mercy express to save time, we will never share or abuse your personal information.

Can I consume cannabis at Mercy?

No, We have worked hard to establish positive relationships with our surrounding neighbors, the City of Cotati and the Cotati Police Department. We are legally licensed by the progressive, visionary City of Cotati, and operate in strict compliance with all local and State Laws.  There currently is no legal consumption of cannabis at Mercy Wellness. We ask that you please kindly follow the Mercy Rules of Conduct. Listed below and given to all Customers and Adults on their first visit to Mercy.

Where can I consume?

Even with a current qualifying physician’s recommendation, there are limits on where you can use medicinal cannabis:

  • You cannot use, smoke, eat, or vape cannabis in public places or in places where tobacco is prohibited.
  • You cannot use cannabis while riding in, or driving a vehicle or boat.
  • Cannabis activity is not allowed within 1,000-feet of a school, daycare center, or youth center while children are present.
  • Even though it is legal in California, employers have the right to prohibit the use of cannabis by their employees and decline an individual for a job. Know your workspace cannabis policies.
  • Property owners may ban the use and possession of cannabis on their privately-owned properties. Private property owners determine their own policies.
  • Even though Cannabis is legal under California Law, you cannot consume or possess cannabis on federal lands like National Parks, even if the park is in California. The cultivation, possession, sale, and use of cannabis in California may remain unlawful under Federal Law and may be subject to prosecution.
Where can I grow?

You can plant, harvest, dry and process up to six cannabis plants inside your private residence, or if your local jurisdiction allows, on the grounds of your private residence. When growing cannabis for personal use, the plants must be in a locked space that is not visible to the public. Check with your local city or county for Personal Cannabis Cultivation Regulations.

Can I sell or give away cannabis?

To sell cannabis, you need a license from the California Bureau of Cannabis Control and CDTFA. If you are 21 or older, you can give away up to one ounce (28.5 grams) of cannabis and up to eight grams of concentrated cannabis to another person 21 or older, but you cannot receive any money or any form of compensation.

Where can I buy Adult-Use Cannabis?

You can only buy recreational cannabis from a licensed adult-use retail outlet licensed by the California Bureau of Cannabis Control. 

What are the penalties for not following regulations?

Violations for possession or cultivation above the permitted limits, furnishing in violation of the law, or for violation of the age restriction are punishable as an infraction, misdemeanor and/or may include fines, depending on the circumstances, and include mandatory drug education or counseling and community service for persons under the age of 18, and may include imprisonment for persons 18 and older.

Is cannabis legal in all California Cities and Counties?

Cities and counties may have stricter laws about cannabis in addition to the state law. Know your local cannabis laws, and check with your City or County.

Can I carry cannabis around with me?

You can carry up to one ounce (28.5 grams) of cannabis and up to eight grams of concentrated cannabis. You may not carry cannabis on federal property, which includes courts and jails.

Now that cannabis is legal, can my employer prohibit me from using it?

Even though it is legal under California law, employers have the right to prohibit the use of cannabis by their employees. Know your workplace cannabis policies.

Can I carry cannabis is my car?

It is against the law for you to have an open container of cannabis in a car or other vehicle while driving or riding. If you have cannabis in a vehicle, it must be in an approved sealed package or container. Otherwise, it must be kept in the trunk of the vehicle. Even if you have a valid physician’s recommendation or a valid county-issued medical marijuana identification card, it is illegal to smoke cannabis in an operating vehicle.

Will cannabis affect my driving?

Yes. Cannabis can negatively affect the skills you need to drive safely, including reaction time, coordination and concentration. Driving under the influence of cannabis is illegal and increases your risk of getting into a car crash.

What about Federal Law?

Even though it is legal under California law, you cannot consume or possess cannabis on federal lands like national parks, even if the park is in California. Airports are also under Federal jurisdiction.

Can I leave California with Cannabis?

No. It is illegal to take cannabis across state lines, even if you are traveling to another state where cannabis is legal.
